These are the T&C’s for your order of a portrait from EmmasPetPortraits. Please read through them carefully before you place your order. When placing an order through the website or over the phone, you are agreeing to the following terms and conditions.

Emma will decide whether to accept the commission.

Items are left with Emma at owners risk. No responsibility will be taken for loss or consequential loss of customers property left with Emma.

A 25% non-refundable deposit is required before commencing a portrait. For customers wishing to place an order outside the UK, full payment is required.

No contract will exist until the required deposit/payment has been received. This contract will then be governed by English law.

As a guideline, Emma will complete the portrait within 2-4 weeks, however this can vary either way due to workload. A completion date will be given when the deposit/payment has been received.  If she is unable to complete the commission by the agreed date because of circumstances outside of her control, you’ll be offered another completion date or to cancel the commission, however, no refund of deposit will be given.

When the portrait has been completed, Emma will email a photo of the painting to ensure complete satifisfaction, it will then be dispatched after full payment has been received. It will be sent Royal Mail guaranteed next day delivery which will include insurance for loss or damage.

If you are not completely satisfied with your portrait, Emma is able to offer you a refund minus the 25% deposit as long as the portrait is returned in it’s original condition within 7 days of receiving it. You are responsible for the return postage costs.

Emma retains full copyright of her work and it must not be copied or reproduced in any manner without her written permission.

You hereby agree that Emma (and people who Emma reasonably allows) has the right to use images of the pet portraits, including on a public basis, on social media and on websites and as part of her portfolio.  If you prefer not to have images of your pet portraits used for these purposes, please contact Emma and she will respect your wishes.

 A word about copyright in the photos that you send.  Surprisingly, the law is that painting a picture from a photo can infringe the copyright in the original photo just as much as if you were to put it through a photocopier!  In other words, doing a painting of a photo and making a photocopy of a photo both potentially involve “copying” the photo.  When you provide us with photos you hereby agree that:

(a)   Emma (and people who Emma reasonably allows) has permission to copy and use the photos (e.g. by making the portrait itself and also by the subsequent use of the images in a portfolio etc as mentioned in the paragraph above) and

(b)   you have the right to grant that permission.

If you wish to cancel the contract to commission a portrait, notice must be given in writing.

All deposits are non refundable.

For overseas orders where the full payment has been taken in advance, it will be at the discretion of Emma as to whether any refund is given.
